Ohio Law and Compliance
State Repossession laws
Ohio is a “self-help” repossession state, where the creditor secures recovery of collateral out of court, and without breach of the peace when the creditor is secured by the contract. Repossession agents must be licensed through the Ohio Department of Commerce and have the requisite bonding and insurance paperwork. All recovery action must follow Ohio Revised Code Chapter 1317 – Going through Transactions, Repossession Action.
Cuyahoga Recording Requirements
All lien documents and title transfers must all be appropriately recorded with the County Fiscal Officer/Transfer and Recording Division. All documents are recorded at:

Redemption Rights
According to the regulations of Ohio, debtors have a right of redemption, even after repossession until the property is sold or contracted for resale. Debtors may redeem their property by making full payment on the loan, plus any reasonable costs associated with the repossession and storage. Debtor notices differ depending upon the type of note and the original agreement/contract.

Upon complete recovery, all documentation must be transferred through the Clerk of Courts:
