Ohio Repossession Laws

Ohio vehicle repossession are covered by Ohio Revised Code Section 1309 (Uniform Commercial Code) and the Ohio Retail Installment Sale Act, depending on the lender type.Some lenders in Ohio’s laws allow repossession 1 day after default without notice to the borrower.

Repossession Process

The creditor is permitted to recover a vehicle that is on private property unless they breach the peace, use force or threats, enter a secured case, or enter a locked/closed garage. Understanding how to recover a vehicle even if it is at a private property is important to understanding the repossession process.

Following Repossession Notice

Bank/Credit Union Loans (UCC): Must send notice no less than 10 days prior to the sale with the debtor’s name, creditor’s name, description of the collateral, method of sale.

Other Lenders (RISA): Must send notice within 5 business days after repossession with a list of the amounts of the default, then send a separate notice at least 10 days prior to the auction.

Sale Requirements

Under RISA, vehicles must be sold at public auction where notice is given with an advertisement in a newspaper of general circulation at least 10 days prior to the auction. Under UCC, vehicles may be sold at a public auction or private sale with a proper notice.

Redemption Rights

Borrowers may redeem their vehicle by paying the total amount owed and repossession costs incurred at any point before their vehicle goes up for sale. Some contracts may include language that allows a borrower to “cure” the default meaning that if a borrower pays the past due amounts plus any repossession costs, their loan is in good standing.
