The geography of Texas certainly offers us distinctive operational considerations, which we have factored as part of our positioning of equipment and personnel throughout the state. We have also learned through winter northern storms what has been referred to as, “shut down I-35” around Waco and the Oklahoma border, can affect what we can response to, so we maintained a base of equipment north of every potential weather choke point as well as south of any choke point. During the summer months in the hot heat of the Trans-Pecos, often this means doing the heavy lifting work in the pre-dawn hours due to the heat. The team will have specific protocols and procedures they must follow to keep equipment in consideration of the humidity of the Gulf Coast.
State Highway Logistics. With regard to our concierge logistical services for the enormous state of Texas we use the in-state interstate highways as follows: I-35 runs from Laredo, across the Austin-San Antonio corridors to Dallas‐Fort Worth; I-10 is 880 miles, running from El Paso, San Antonio and Houston and on through to Louisiana; I-45 connects north from Dallas to Houston and on to Galveston; while I-20 connects the Midland-Odessa oil country in West Texas to East Texas.
I’m learning about rural logistics headaches. Texas has 254 counties and rural areas lumps everywhere in all of the countrysides. Texas Legal Issues
Texas repossession process. Texas does not require, like many states there are 2 or 3 that do require a special license for repossessors. Speedy Repo is an experienced repo company and has all of the required licensure in Texas and every tow truck operator is TDLR licensed. We follow Texas Business & Commerce Code § 9.609 such that repossession companies have the right to “peacefully” take possession of property without taking possession through court order. Notable Distinct Texas Requirements: Texas has no grace period for repossession upon default of a property by the debtor. We know and understand what “breach of peace” means by the legal test in MBank El Paso v. Sanchez. After we document the event, we do always verify and know which counties want to let any notification contact go through their sheriff office, and which counties don’t want affected parties properly notified before repossession – there are 254 counties in Texas!
Documentation Procedures: All teams know and understand their responsibilities for compliance under the provisions in Texas Business & Commerce Code § 9.611 that require 10-day, authentic notice to be given without costs prior to sale. Upon an offer of sale we totally comply with the Texas DMV for their request and explicitly explain each specific county’s documentation procedures for documentation – e.g., Harris County e-filing vs a rural Texas County documentation (paper work).
